Overview & acceptance

This website is operated by Silk Serenade Pty Ltd (ABN 72 696 598 151), trading as The Plants Corner™. Throughout these terms, "we", "us" and "our" refer to The Plants Corner. Our store is hosted on Shopify Inc., which provides the e-commerce platform enabling us to sell products to you.

By visiting our website and/or purchasing from us, you agree to be bound by these Terms of Service, including any additional terms, policies and notices referenced herein. These terms apply to all users of the site — browsers, customers and any other visitors.

Please read these Terms of Service carefully. If you do not agree to these terms, you may not access or use our website or services.

Updates to these terms We reserve the right to update these Terms of Service at any time by posting changes to this page. Your continued use of the website after any changes constitutes your acceptance of the new terms. We recommend checking this page periodically.

Section 2

Online store terms

By agreeing to these Terms of Service, you confirm that you are at least 18 years of age, or that you have the consent of a parent or guardian to use this site.

You may not use our products or services for any illegal or unauthorised purpose
You must not violate any laws in your jurisdiction in connection with your use of this service
You must not transmit any viruses, malware or code of a destructive nature
A breach of any of these terms may result in immediate termination of your access to our services

Section 3

Products & pricing

All products are sold subject to availability. We have made every effort to display product colours and images as accurately as possible. However, we cannot guarantee that your device's display of any colour will be accurate.

Prices are displayed in Australian dollars (AUD) and are subject to change without notice. We reserve the right to modify or discontinue any product or service at any time without liability to you or any third party.

We reserve the right to limit sales of our products to any person, geographic region or jurisdiction on a case-by-case basis. We also reserve the right to limit quantities of any products or services we offer.

Product descriptions We take care to ensure product descriptions are accurate. If a product you receive is materially different from its description on our website, your rights under the Australian Consumer Law apply — see Section 7.

Section 4

Orders & payment

We reserve the right to refuse any order placed with us. We may, at our sole discretion, limit or cancel quantities purchased per person, per household or per order — including orders placed under the same customer account, credit card, or billing/shipping address.

You agree to provide current, complete and accurate purchase and account information for all purchases. You agree to promptly update your account information so that we can complete your transactions and contact you as needed.

In the event we modify or cancel an order, we will attempt to notify you using the contact details provided at the time of purchase.

Payment security Credit card and payment information is always encrypted during transfer. We do not store your full payment details on our servers. Payments are processed securely through Shopify Payments and other approved payment providers.

Section 5

Delivery & authority to leave

All orders are dispatched from our Sydney warehouse within 4 business days of payment. Estimated delivery timeframes are provided by our courier partners and are not guaranteed. For full delivery information see our Shipping Policy.

Authority to Leave (ATL)

By default, all deliveries are made on an Authority to Leave basis. Our courier partners are authorised to leave parcels in a safe location at the delivery address and photograph the parcel as proof of delivery if no one is available to accept the delivery. This is standard practice across Australian courier services.

If you require signature on delivery or do not wish for your parcel to be left unattended, you must notify us at hello@theplantscorner.com.au or add a note in the Order Notes field at checkout before your order is dispatched. We are unable to change delivery instructions once an order has been collected by our courier.

Liability after delivery Once our courier partner delivers your order to the correct address and obtains proof of delivery — including a photograph of the delivered parcel — The Plants Corner's delivery obligation is fulfilled under these Terms of Service and our Shipping Policy. We are not liable for parcels that are lost, stolen or removed after confirmed delivery to the correct address. Any loss occurring after confirmed delivery is a matter for the customer to pursue with their local police authority.

Non-returnable items — Fibrestone pots
Due to their fragile nature and the high risk of damage in transit, fibrestone pots and planters are not eligible for return under our change of mind returns policy. If your fibrestone pot arrives damaged or faulty, please contact us within 48 hours with photos and we will arrange a replacement or refund for confirmed transit damage. This exclusion does not affect your rights under the Australian Consumer Law for faulty or damaged goods.

Shipping Protection
We offer optional Shipping Protection at checkout. If you have purchased Shipping Protection and your order is lost or damaged in transit, we will arrange a full replacement or refund promptly. If you declined Shipping Protection at checkout, our ability to offer a replacement or refund for transit loss or damage may be limited to the outcome of our courier partner's investigation. Nothing in this clause limits your rights under the Australian Consumer Law.

PO Box addresses
We are unable to deliver to PO Box addresses. Our courier partners require a physical street address for all deliveries. If a PO Box address is provided at checkout we will contact you to arrange an alternate delivery address before dispatching your order.

Section 6

Returns & refunds

We offer a 14-day return policy for change of mind returns on most products. Items must be returned in their original, unused condition and in original packaging. Return shipping costs for change of mind returns are the responsibility of the customer.

If your item arrives damaged or is materially different from its description, we will cover return shipping costs and provide a full replacement or refund. Please report transit damage within 48 hours of delivery with photos of the product and packaging.

Section 7

Australian Consumer Law

Our products come with guarantees that cannot be excluded under the Australian Consumer Law (Competition and Consumer Act 2010). You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have goods repaired or replaced if they fail to be of acceptable quality and the failure does not amount to a major failure.

Nothing in these Terms of Service excludes, restricts or modifies any right or remedy, or any guarantee, warranty or other term or condition, implied or imposed by the Australian Consumer Law that cannot lawfully be excluded or limited.

Your ACL rights The benefits provided by our Returns Policy are in addition to, and do not limit, your rights under the Australian Consumer Law. If you believe a product is faulty or does not match its description, please contact us at hello@theplantscorner.com.au and we will work with you to resolve the issue.

Intellectual property

All content on this website — including but not limited to text, product descriptions, photography, graphics, logos, brand name and design — is the property of Silk Serenade Pty Ltd (trading as The Plants Corner™) or its content suppliers, and is protected by Australian and international copyright and intellectual property laws.

You may not reproduce, duplicate, copy, sell, resell or exploit any portion of this website or its content without our express written permission. Unauthorised use of our content may give rise to a claim for damages or constitute a criminal offence.

Trademark
"The Plants Corner™" is a trademark of Silk Serenade Pty Ltd, with a trademark application filed with IP Australia. You may not use the name "The Plants Corner", our logo or any confusingly similar mark without our prior written consent. Unauthorised use of our trademark may give rise to legal action.

Section 9

User conduct

In addition to the general conditions above, you are specifically prohibited from using our website or its content to:

Engage in any unlawful, fraudulent or harmful activity
Infringe upon the intellectual property rights of others
Harass, abuse, defame or discriminate against any person
Submit false, misleading or inaccurate information
Upload or transmit viruses or malicious code of any kind
Collect or track the personal information of other users
Interfere with or circumvent the security features of our website
Engage in spam, phishing or scraping of any kind

We reserve the right to terminate your access to our website and services for violating any of the above prohibited uses.

Reviews and comments If you submit a review or comment on our website, you confirm that it does not infringe any third-party rights, contains no unlawful or defamatory material, and is accurate to the best of your knowledge. You are solely responsible for the accuracy of any content you submit.

Section 10

Privacy & personal information

Your submission of personal information through our store is governed by our Privacy Policy. By using our website, you consent to the collection and use of your personal information as described in our Privacy Policy.

We comply with the Privacy Act 1988 (Cth) and the Australian Privacy Principles in the handling of your personal information. We do not sell your personal information to third parties.

Section 11

Disclaimer & limitation of liability

We do not guarantee that your use of our service will be uninterrupted, timely, secure or error-free. The service and all products delivered through it are provided "as is" and "as available" subject to the guarantees that cannot be excluded under the Australian Consumer Law.

To the extent permitted by law, The Plants Corner™ (Silk Serenade Pty Ltd), its directors, officers, employees, agents and service providers shall not be liable for any indirect, incidental, special, consequential or punitive damages arising from your use of our service or products — including lost profits, lost data or replacement costs.

ACL override This limitation of liability does not apply to any rights or remedies you have under the Australian Consumer Law that cannot lawfully be excluded. Our liability for a failure to comply with a consumer guarantee under the ACL is limited to the extent permitted by law.

Section 12

Indemnification

You agree to indemnify, defend and hold harmless Silk Serenade Pty Ltd (trading as The Plants Corner), its directors, officers, employees, agents, contractors and service providers from any claim, demand or damage — including reasonable legal fees — arising from your breach of these Terms of Service or your violation of any law or the rights of any third party.

Section 13

Governing law

These Terms of Service and any separate agreements are governed by and construed in accordance with the laws of New South Wales, Australia. You submit to the exclusive jurisdiction of the courts of New South Wales for the resolution of any disputes arising in connection with these terms.

If any provision of these Terms of Service is found to be unlawful, void or unenforceable, that provision will be enforceable to the fullest extent permitted by law, and the remaining provisions will continue in full force and effect.

We reserve the right to update, change or replace any part of these Terms of Service at any time by posting updates to this page. The date of the most recent revision will be noted at the top of the page.

Your continued use of our website or services following any changes constitutes your acceptance of the revised terms. We recommend reviewing this page periodically. For material changes, we will make reasonable efforts to notify you by email or by a prominent notice on our website.
